This Terms of Use Agreement (“Agreement”) sets forth the standards of use of the Need A Print online ordering process. By using the Need A Print (trading name of ER-Media LTD) website, you (also sometimes referred to as the “Customer”) agree to these terms and conditions. If you do not agree with this Agreement, you should immediately cease all usage of this website. Need A Print  (also sometimes referred to as “We”) reserves the right, at any time, to modify the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted on this website. Your continued use of the website after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications.

Change Orders

Any jobs that have been approved or “sent to print” cannot be altered or changed due to the automated process that results from the “send to press” action. If a request is made for a job change before the digital proof is approved, including, but not limited to, turn around time, quantity, shipping method, etc, a change order fee of £9.00 inc vat will be deducted from the refund.

Turn Around/Production Times

All turn around times are based on business days Monday through Friday and exclude all national and bank holidays. Printing turnaround time starts when your order is submitted and approved. Please note that if your artwork or design files fail to meet our file requirements, your job status will be changed to "Need Artwork" and your printing turn around time will be reset. All jobs submitted into production before midnight will begin production the following business day. As an example, if a 3 day turn around for a job is submitted, approved, and sent to press on a Monday before Midnight, Day 1 of turn around time is Tuesday and the job would be shipped on Thursday, Day 3 of turn around time.  However,  if we are able to turn the job around quicker we will do so.

Refund Policy

All sales are final once submitted. No refunds can be issued after the job is “sent to press” due to the costs involved. Customers must notify Need A Print within 1 business day of order acceptance to report any defects discovered in the approved product artwork. 100% of the product must be returned to Need A Print within 5 days from the day the job was delivered if you are unsatisfied with the print quality. In the event the claim is approved by Need A Print, a re-print at no cost will be shipped to the Customer via the original paid shipping method.

Marketing Promotions and Discount Codes

Please note that all prices and specifications are subject to change without notice. Check Need A Print.co.uk for an updated online advertised price. Qualifying purchases should be placed online along with the applicable code and must be paid in full before the promotion expiration. Offers are not valid for previous purchases. Non-shipping related promotions apply to printing charge only; custom quotes, mailing postage, shipping charges and sales vat, etc. is excluded from offer discounts.

Shipping

Need A Print ships via CityLink, DHL and Royal Mail. Once a package has shipped, Need A Print will not be responsible for late packages. Delivery dates are not guaranteed; unforeseen delays by couriers/weather may result in additional transit time. No refund of shipping charges will be made on any job once it has shipped due to uncontrollable circumstances.

Disclaimer of Warranties

THE NEEDAPRINT.CO.UK WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEEDAPRINT.CO.UK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE USE OR THE RESULTS OF THIS WEBSITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NEEDAPRINT.CO.UK WILL HAVE NO LIABILITY FOR ANY INTERRUPTIONS IN THE USE OF THIS WEBSITE. Limitation of Liability

Need A Print will not be liable for any damages whatsoever, including any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this website or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Need A Print has been advised of the possibility of such damages.

Indemnification

Customer agrees to indemnify and hold Need A Print, its affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Customer’s use of the website, the violation of this Agreement, or infringement by Customer, or other user of the website using Customer’s computer, of any intellectual property or any other right of any person or entity.

Modifications and Interruption to Service

Need A Print reserves the right to modify or discontinue the website with or without notice to the Customer. Need A Print will not be liable to Customer or any third party should Need A Print exercise its right to modify or discontinue the website. Customer acknowledges and accepts that Need A Print does not guarantee continuous, uninterrupted or secure access to our website, as operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

Production Outsourcing

Need A Print reserves the right to assign portions or entire jobs to outside vendors if it determines in its sole discretion, should the case arise.  We print all digital work in house.  Only litho work and outdoor banners are outsourced due to the printing technique.

Design/Artwork Promotion

Need A Print reserves the right to promote artwork designed by our staff and/or materials produced through our website.

Third-Party Sites

This website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therefor. We encourage all Members to review said privacy policies of third-parties’ sites.

Compliance with Laws

Customer assumes all knowledge of applicable law and is responsible for compliance with any such laws. Customer may not use the Service in any way that violates applicable laws, regulations or other government requirements. Customer further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable  law or regulation.

Copyright and Trademark Information

All content included or available on this site, including site design, text, graphics, interfaces, and the selection and arrangements thereof, is ©2008 Need A Print, will all rights reserved, or is the property of Need A Print and/or third parties protected by intellectual property rights. Any use of materials on the website, including reproduction for purposes other than those set forth above, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of Need A Print, is strictly prohibited. Customer agrees that it will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized officer of Need A Print.

Need A Print is a proprietary mark of ER-Media LTD. Need A Print branding may not be used in connection with any product or service that is not provided by ER-Media LTD in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Need A Print.

All other trademarks displayed on Need A Print‘s website are the trademarks of their respective owners, and constitute neither an endorsement nor a recommendation of those Vendors. In addition, such use of trademarks or links to the web sites of Vendors is not intended to imply, directly or indirectly, that those Vendors endorse or have any affiliation with Need A Print

Other Terms

If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Customer. Customer agrees that by accepting this Terms of Use Agreement, Customer is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
